Estate Management
Estate Planning
(UK)
Many UK Muslims assume their estate will be distributed Islamically. In practice, UK law and how assets are owned can override intentions — creating surprises, delays, and disputes for families.
"It is not permissible for any Muslim who has something to will to stay for two nights without having his last will and testament written and kept with him."
The problem
Issues that commonly
create risk
No will / no estate plan (intestacy)
Dying without a will means UK intestacy rules apply — these differ significantly from Islamic inheritance principles and can leave key family members without intended provision.
Asset ownership overriding intentions
Joint property, jointly held bank accounts, and similar assets pass automatically to the surviving owner — bypassing your will entirely, regardless of your wishes.
Blended families and stepchildren
Stepchildren do not inherit automatically under UK intestacy rules. Without explicit provision, they may receive nothing — even where there is a clear moral intention to include them.
Lifetime gifts not recorded
Unrecorded gifts frequently lead to family conflict, misunderstandings about the 7-year rule, and unexpected Inheritance Tax exposure for estates and recipients.
Misunderstood spouse and parents' entitlements
Islamic and UK law treat spousal and parental inheritance rights very differently. Many families are unaware of the gap until it is too late to address it.
Inheritance Tax exposure and executor burden
Unplanned IHT liability can force difficult decisions on executors and reduce the estate available to beneficiaries substantially — often avoidably.
